  1. Definition

      is referred to in these general terms and conditions as the seller.
    • User/Customer: Any website visitor, including private and business customers such as gyms, who makes a purchase through Nspire Sports’ webshop or via another Nspire Sports channel.
    • Products: All goods offered in the webshop or via another Nspire Sports channel, such as sports articles, clothing, and accessories.
    • Agreement: The purchase agreement between Nspire Sports and the Customer for Product deliver
  2. Applicability
    • These General Terms and Conditions apply to all offers, orders, and agreements via the webshop or other Nspire Sports channels.
    • By placing an order, the Customer agrees to these terms.
    • Nspire Sports reserves the right to modify these General Terms and Conditions. Customers are advised to regularly review the terms.
  3. Offer and Prices
    • All Products and prices on the website or other Nspire Sports channels are subject to availability and can be changed without prior notice.
    • Prices for private customers include VAT. For business customers, prices are listed exclusive of VAT, unless otherwise indicated.
    • Nspire Sports is not bound by obvious errors or mistakes in the offer on the website or other channels.
  4. Orders and Agreement
    • An Agreement is established once Nspire Sports has confirmed the order.
    • Nspire Sports reserves the right to refuse orders or set additional conditions, particularly for business customer or large quantity orders.
    • Additional conditions may apply for business customers, including minimum order amounts and specific payment terms.
  5. Payment
    • Private customers can pay using payment methods offered on the website.
    • Alternative payment conditions may be agreed upon for business customers, such as invoice payment.
    • If a business customer does not pay within the specified period, Nspire Sports reserves the right to charge administrative costs and suspend further deliveries.
  6. Delivery and Delivery Time
    • Nspire Sports aims to deliver orders within the indicated delivery time but cannot be held liable for delays outside its control.
    • Delivery costs are clearly indicated during the order process and may vary for private and business customers.
    • Upon receipt of delivery, the Customer must inspect the Products. Any defects must be reported to Nspire Sports within 14 days of delivery.
  7. Returns and Right of Withdrawal
    • Private customers have the right to cancel an order within 14 days of receipt without stating a reason (right of withdrawal). The customer must return the products unused and in the original packaging.
    • Business customers have no legal right of withdrawal unless otherwise agreed in writing. Specific arrangements for return shipments by business customers are agreed in advance.
    • Return shipping costs are for the customer’s account, unless it concerns an error by Nspire Sports or a defective product.
  8. Warranty and Liability
    • Nspire Sports guarantees that delivered Products meet the specifications listed in the webshop.
    • If a product is found defective, Nspire Sports will at its discretion either provide a replacement product or refund the purchase price.
    • Nspire Sports is not liable for any indirect damage, including consequential damage, loss of profit, or immaterial damage, unless there is intent or gross negligence.
  9. Complaints Procedure
    • Customers can submit complaints about Nspire Sports’ products or services in writing using the contact information on the website.
    • Nspire Sports will respond within 14 days of receiving the complaint. If a complaint requires a longer processing time, Nspire Sports will notify the Customer within 14 days.
  10. Privacy and Data Protection
    • Nspire Sports processes personal data in accordance with the General Data Protection Regulation (GDPR) and the privacy statement on the website.
    • Personal data is only used for order processing and improving Nspire Sports’ services.
  11. Applicable Law and Disputes
    • Dutch law applies to all agreements between Nspire Sports and the Customer.
    • Disputes arising from or related to an agreement will be exclusively submitted to the competent court in the Netherlands.
